The Quality Assurance Act (Wkb) has once again been postponed. This time the law is expected to come in on Jan. 1, 2024. The law should ensure that the quality of construction works is improved and strengthen the position of the client. The new law has a huge impact on the working methods and responsibilities of the building contractor. Namely, liability will largely fall on the contractor. To make implementing the law a lot easier, Trimble Connect is therefore coming up with a new checklist tool!
What does the new law actually entail? With the Wkb, the government is redesigning quality control before and during construction. Previously, construction supervision was a task of the municipality, but as of 2024, the holder of the building permit must engage a private party for this purpose: the quality assurance officer. This person will supervise during construction and issue a declaration after construction. This new way of working should lead to better construction quality, fewer construction faults and fewer defects that only come to light after delivery. This ultimately reduces construction failure costs.
Besides reducing failure costs, the new law also improves the client's position. Starting this summer, the contractor will be liable for all construction defects caused by himself. There is also a duty of information towards the client. A contractor must tell the customer in advance whether and how he is insured against bankruptcy and defects after completion. "To make it easier for the contractor to comply with the Wkb, we are currently busy creating a checklist in the cloud platform Trimble Connect," says Eelco van Es, account manager at Construsoft.
"With the Wkb, contractors become responsible for all defects, even if they only come to light after delivery," Van Es explains. "The burden of proof also lies with the contractor. A file must be built of each construction project, showing that all contractual requirements have been met." So processes and their recording must be in good order. This greatly increases the registration burden on contractors. "Working on paper is no longer a workable method," Van Es explains. "The cloud platform Trimble Connect then offers a solution. The checklist ensures that a contractor can soon walk around the construction site and easily record and register a few things."
